Монгол Улсын Үндсэн хуулийн 22 дугаар зүйлийн 2 дахь хэсэгт УИХ бүрэн эрхээ хэрэгжүүлэх боломжгүй гэж нийт гишүүний гуравны хоёроос доошгүй нь үзсэн, эсхүл Ерөнхийлөгч УИХ-ын даргатай зөвшилцөн санал болгосон тохиолдолд УИХ нийт гишүүний гуравны хоёроос доошгүйн саналаар өөрөө тарах шийдвэр гаргаж болохоор заасан. Харин УИХ-ын тухай хуулийн 34 дүгээр зүйл энэ механизмыг бүр тодорхой болгож өгсөн байдаг. УИХ-ын нийт гишүүний гуравны хоёроос доошгүй нь УИХ бүрэн эрхээ хэрэгжүүлэх боломжгүй гэж үзэж, хугацаанаас өмнө тарах тогтоолын төсөл өргөн мэдүүлнэ. Уг төслийг мөн УИХ-ын нийт гишүүний гуравны хоёроос доошгүй нь дэмжсэн байх ёстой. Ерөнхийлөгч УИХ-ын даргатай зөвшилцөн хугацаанаас өмнө тарах тогтоолын төсөл өргөн мэдүүлсэн ч эцэст нь мөн л УИХ-ын нийт гишүүний гуравны хоёроос доошгүй нь дэмжих шаардлагатай болох юм. Өөрөөр хэлбэл өнөөгийн 126 гишүүнтэй парламентад энэ босго 84 гишүүн дэмжсэнээр УИХ тарах боломж бүрдэнэ.

Иргэдийн цахим санал, өргөдөл, гарын үсэг бол улс төрийн болон нийтийн оролцооны илэрхийлэл байж болно. Гэхдээ тэр санал өөрөө Үндсэн хуулийн 22 дугаар зүйлд заасан УИХ тарах шийдвэрийг орлохгүй. D-Parliament-ийн үндсэн зорилго олон нийтийн санал бодлыг хууль тогтоох үйл ажиллагаанд тусгах, иргэдийн дуу хоолойг төрийн шийдвэрт хүргэхэд оршдог. Тиймээс Х.Ганхуягийн санаачилга хууль зүйн утгаараа “иргэдийн саналаар УИХ тараах” механизм бий болгож байгаа хэрэг биш. Харин улс төрийн утгаараа зүгээр л пиар хийж яваа нэгэн.
